1. About these terms
These terms apply when you use the Wecheer app or website to take part in a brand's campaign or program. The platform is operated by Wecheer SA, avenue Victor-Ruffy 5, 1012 Lausanne, Switzerland ("Wecheer", "we", "us"). By creating an account or taking part in a campaign, you accept these terms and our Privacy Policy.
2. Who does what
- Wecheer runs the platform: your account, the app, the validation of your entries and the technical delivery of rewards on the brand's behalf. Wecheer does not create, sponsor or fulfil the brands' campaigns and is not a party to the agreement between you and a brand.
- The brand organises each campaign. The brand sets the campaign rules (who can take part, what to buy or do, the rewards, dates and limits) and offers, funds and is responsible for the rewards.
- Each campaign shows its own rules in the app, and may also have the brand's own terms and conditions and privacy notice. When you join a campaign, you accept them for that campaign. They apply together with these terms: where they cover a point specific to the campaign, they apply for that campaign; where a campaign has no rules or terms of its own on a point, these terms apply.
- You can leave a campaign at any time in the app. Wecheer then stops sharing your new data with that brand.
3. Who can take part
- You must be at least 18 years old, or older where the campaign or the law requires it (for example 21 for some alcohol, tobacco or nicotine campaigns). We or the brand may ask you to verify your age.
- One account per person, with true and up-to-date information. Your account cannot be transferred.
- Keep your login details and one-time codes secure. You are responsible for activity on your account.
- Some campaigns are open only in certain countries or to certain groups.
4. What the platform does
The platform lets you join brand campaigns and loyalty programs, prove a purchase or an action, and earn points, prizes or rewards. Depending on the campaign, you can scan a QR code or a unique code on a pack, upload a receipt, take a photo of a product, follow a personal link, answer a survey, play a game, or use WhatsApp. Some programs are for consumers; others are for professionals such as shop, bar or restaurant staff. Wecheer does not charge you for using the platform.
5. Taking part
- Follow the rules of each campaign you join.
- Each entry must relate to a genuine purchase or action of your own, made within the campaign period. Each receipt, code or link can be used only once per campaign, and codes must not be shared.
- Keep your proof of purchase (for example the original receipt) until the reward is received; we or the brand may ask for it.
6. Your submissions
Receipts, photos, codes and other content you submit must be genuine, your own and not altered. You allow Wecheer, and the brand of the campaign, to use them to check your entry, deliver your reward and run the campaign, as described in our Privacy Policy. We never sell your personal data.
7. Automated validation
To check entries quickly, the platform uses automated tools, including AI, to read receipts and recognise products. Our team monitors these checks and reviews entries that are flagged. If you think an entry was rejected by mistake, write to support@wecheer.io and a person will review it.
8. Fraud checks
We check entries and accounts for fraud and misuse on an ongoing basis, across all campaigns on the platform. If we or the brand reasonably suspect fraud, misuse or a breach of these terms or of campaign rules, we may reject or hold entries, withhold or cancel points and rewards, refuse redemptions, ask for more information, suspend or close the account, and report the conduct to the relevant authorities. We do not explain how our checks work, to keep them effective.
9. Points and rewards
- Points and rewards follow the rules of the campaign, including how many you can earn, when they expire and what they can be exchanged for.
- Rewards depend on availability. They have no cash value and cannot be transferred or sold, unless the campaign says otherwise or the law requires it. Once redeemed, a reward is final.
- You may need a complete profile before you can redeem a reward. Some rewards are redeemed in person at listed locations, using a redemption QR code in the app.
- Many rewards (gift cards, vouchers, prepaid cards, products or services) are provided by a third party, directly or through a reward delivery partner. When you claim such a reward, the terms of that provider and of the reward issuer also apply, and you must follow them. The issuer is responsible for its own product or service.
- Rewards may be taxable in some countries. Any tax due is the responsibility of the brand and/or you, as the law provides. Wecheer does not give tax advice.
- The brand may change a campaign's mechanics, replace a reward with one of similar value, or end a campaign early, where the campaign rules or the law allow it. Rewards you have already earned are honoured, unless they were obtained in breach of these terms or the campaign rules.
10. Professional programs
If you join a program as a professional (for example as a cashier, waiter or member of staff), you confirm that your employer allows you to take part and to receive the rewards.
11. Suspension and closure
We may suspend or close your account, and cancel points or rewards linked to the breach, if you break these terms or a campaign's rules, act fraudulently or unlawfully, or misuse the platform. Where possible, we will tell you the reason, and you can ask us to review the decision by writing to support@wecheer.io.
12. Your account
You can delete your account in the app at any time. It stays inactive for 30 days, in case you change your mind, and is then deleted; unused points and rewards are lost. We also delete accounts that have been inactive for 24 months, as explained in our Privacy Policy.
13. App licence and intellectual property
We give you a personal, revocable, non-exclusive and non-transferable licence to use the app, only to access the platform. The platform, the app and our materials belong to Wecheer; brand names, logos and campaign content belong to the brands. You may not copy, modify, decompile or exploit them, except where the law allows. You may not use bots or scripts, interfere with the platform, or try to access it in ways we did not intend.
14. Liability
- We work to keep the platform available and accurate, but it is provided as it is. We may change, suspend or stop any feature, and we do not guarantee that the platform will always be available or error-free.
- Rewards are offered and funded by the brand that runs the campaign. The brand is responsible for them, together with the reward issuer for its own product or service, and any claim about a reward, its value, availability or delivery is to be made to the brand. Wecheer is not responsible for the brands' campaigns, products or rewards, or for problems with your device, network or mobile operator.
- To the fullest extent permitted by law, Wecheer is not liable for any loss or damage arising from your use of the platform, a campaign or a reward.
- This does not apply where the law does not allow liability to be excluded, in particular for intent or gross negligence.
15. Applicable law, courts and language
These terms are governed by Swiss law, and the courts of Lausanne, Switzerland, have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring a claim before its courts where that law allows. These terms are provided in English; any translation is for convenience and the English version prevails.
16. Changes
We may update these terms, for example when the platform or the law changes. We will tell you about important changes in the app before they apply and ask you to accept them at your next login. If you do not agree, you can delete your account.
